Terms of Service (GTC)

Effective from: August 14, 2026, until revoked.

The contract concluded on the basis of this document is not filed (it is not accessible ex post; the conclusion of the contract is proven by the acceptance of the quotation and billing data), is concluded by an implied legal statement, does not qualify as a written contract, is written in Hungarian/English, and does not refer to a code of conduct. If you have any questions regarding the operation, ordering, and fulfillment process of our services, we are at your disposal at the provided contact details.

1. DETAILS OF THE SERVICE PROVIDER

2. GENERAL PROVISIONS

2.1. Matters not regulated in these General Terms and Conditions (GTC), as well as the interpretation of these GTC, shall be governed by Hungarian law, with particular regard to the provisions of Act V of 2013 on the Civil Code ("Ptk.") and Act CVIII of 2001 on certain issues of electronic commerce services and information society services (Elker. tv.). The mandatory provisions of the relevant legislation shall apply to the parties without any special stipulation.

2.2. These GTC shall remain in force until revoked. The Service Provider shall publish any amendments on the website. The amendments do not affect previously concluded contracts (no retroactive effect).

2.3. Target audience and Clients: The Service Provider (EJIPOS) primarily provides B2B (Business-to-Business) services to institutions, universities, research centers, professional societies, and businesses. If the Client is a natural person acting outside their profession, independent occupation, or business activity (Consumer), the consumer protection rules of Government Decree 45/2014 (II. 26.) shall also apply to them.

3. SCOPE OF SERVICES AND PRICING

3.1. The service packages presented on the website (https://ejipos.org) (A. Launch Module, B. Operations Module, C. Internationalization, Audit & Mentoring) are for informational purposes and do not constitute a direct, binding offer. The actual service content is formulated based on the Client's unique needs in all cases.

3.2. The remuneration for the services (e.g., one-time setup fees, monthly or annual hosting fees) is determined based on a customized price quote, in Forints (HUF) or Euros (EUR). The Service Provider is subject to subjective tax exemption (AAM), so the quoted prices do not include VAT (Gross = Net).

4. ORDER AND CONTRACTING PROCESS

4.1. Request a quote: The Client can initiate a quote request by filling out the form on the website or directly via email (info@ejipos.org).

4.2. Customized quote: Following the consultations, the Service Provider sends a customized, written (email) price quote to the Client, which accurately contains the technical and professional specifications, deadlines, and remuneration.

4.3. Establishment of the contract: The contract (Order) is established by the Client's written (email) acceptance of the customized quote or by the signing of a separate written service contract.

4.4. Payment method: Payment is made by bank transfer based on an electronic invoice issued by the Service Provider (KBOSS.hu Kft. - szamlazz.hu). Hosting fees are invoiced in billing cycles as mutually agreed (monthly/annually).

5. SERVICE PROVISION AND LIABILITY

5.1. Technical hosting: The Service Provider undertakes the installation of the OJS (Open Journal Systems) platform, its security updates, the provision of the server infrastructure, and data backups according to the agreed SLA (Service Level Agreement).

5.2. Content liability: The Client (Editorial Board / Publisher) is solely responsible for the scientific articles and studies published in the installed journal system (OJS), the copyright compliance of uploaded images, and adherence to publishing and research ethics standards. The Service Provider (EJIPOS) assumes no editorial, proofreading, or scientific peer-review liability.

5.3. Delay and Force Majeure: The Service Provider cannot be held liable for server downtimes or network outages caused by a third party beyond its control (e.g., data center, ISP) or by force majeure events (e.g., natural disasters, war).

6. RIGHT OF WITHDRAWAL AND TERMINATION

6.1. Business partners (B2B): In the case of businesses and institutions, the conditions for termination and withdrawal are governed by the individual service agreement between the parties. In the case of an open-ended hosting contract, the standard notice period (unless agreed otherwise) is 30 days.

6.2. Consumers' right of withdrawal: If the Client qualifies as a Consumer under the Civil Code, they are entitled to withdraw from the contract without justification within 14 days. However, in the case of a contract for the provision of services, the Consumer loses their right of withdrawal if the Service Provider began performance with the Consumer's explicit, prior consent, and the service has been fully performed (e.g., OJS system installed and handed over).

7. COPYRIGHTS, CONTENT PROTECTION, AND RESERVATION OF RIGHTS

7.1. The https://ejipos.org website, its layout, structure, branding elements, graphical solutions, text content, image materials, service descriptions, and other content appearing on the website are protected by copyright and, where applicable, related rights.

7.2. The Service Provider reserves all rights regarding the content appearing on the website. Without the prior, explicit, and written permission of the Service Provider, it is prohibited to do the following with the entirety or any part of the content appearing on the website, including but not limited to:

7.3. Placing a link pointing to the website is permitted, provided it does not harm the Service Provider's reputation and does not create a false impression of cooperation.

7.4. If the infringement is committed by a business, competitor, or other market player, and the adoption of the content is suitable for gaining an unfair advantage or deception by exploiting the Service Provider's market performance, the Service Provider may take action against the infringer on a competition law basis in addition to copyright claims (compensation, grievance award, removal of infringing content).

8. COMPLAINT HANDLING PROCEDURE

8.1. Our goal is to fulfill all orders in appropriate quality, to the complete satisfaction of the client. The Client can submit any complaints to the email addresses info@pitservice.hu or info@ejipos.org.

8.2. The Service Provider is obliged to answer the written complaint in writing within thirty days of receipt, and in case of rejection, to provide justification.

8.3. If the Client qualifies as a Consumer and the complaint handling does not lead to a result, they are entitled to turn to the Conciliation Body according to their place of residence or stay (e.g., Csongrád-Csanád County Conciliation Body, 6721 Szeged, Párizsi krt. 8-12, Hungary), or initiate the procedure of the Consumer Protection Authority.

9. MISCELLANEOUS PROVISIONS

9.1. The Service Provider is entitled to use a contributor (e.g., server hosting partner - Contabo GmbH) to fulfill its obligations.

9.2. The parties record that the Service Provider's infrastructure and enterprise operate in Hungary. The relationship between the parties is governed by Hungarian law. In the event of a possible legal dispute, the parties submit to the jurisdiction of the Hungarian court according to the Service Provider's headquarters, unless the law establishes exclusive jurisdiction in proceedings against a Consumer.
